The Labour Code in article R.4224-14 envisages that «the workplace should be equipped with emergency material adapted to the type of risks and easily accessible,» and article R. 4224-23 states that «there should be signs on the material.»Articles L452-1 and beyond of the Social Security Code, state that «by virtue of their work contract, the employer has a duty of care for the worker and non compliance with this duty is gross negligence by the employer, when the employer was aware or should have been aware of the danger and did not take measures to keep the worker safe.
